Johnson County Bistate - Union Station
Ballot Question - November 1996

Shall the following be adopted?

Shall a retail sales tax of one-eighth (1/8) of one cent be levied and collected in Kansas and Missouri metropolitan culture district consisting of Johnson County, Kansas, Jackson County, Missouri and such other counties which may join the district, including the counties of Wyandotte in Kansas and Clay and Platte in Missouri? The retail sales tax shall terminate upon the collection from the district of $118,000,000. The proceeds of the tax will be used to restore, repair, construct, reconstruct, remodel, acquire, furnish and equip Union Station and a science museum to be known as Science City at Union Station, parking facilities and all things necessary or incidental to this project. The Union Station complex will be owned by Union Station Assistance Corporation, a not-for-profit corporation. The cost of the project is $194,000,000, of which $76,000,000 will be provided by federal and state grants and private contributions. There also will be a $40,000,000 endowment provided by private contributions to help support operations and maintenance.

RESOLUTION AUTHORIZING PARTICIPATION IN KANSAS AND MISSOURI METROPOLITAN CULTURE DISTRICT AND APPROVING A RETAIL SALES TAX OF ONE-EIGHTH (1/8) OF ONE CENT FOR THE RESTORATION OF UNION STATION AND THE CONSTRUCTION OF A SCIENCE MUSEUM AT UNION STATION SUBJECT TO APPROVAL BY THE ELECTORATE OF THE COUNTY.

Resolution No. 079-96

WHEREAS, the legislature of Kansas and Missouri have each enacted the Kansas and Missouri metropolitan culture district codified at K.S.A. 12- 2536 et seq. and 70.500 et seq. RSMo. as amended, which was approved by the 103rd United States Congress in 1994 pursuant to United States House of Representatives Resolution 4896, creating the ability of certain counties in Kansas and Missouri to form a metropolitan culture district; and

WHEREAS, the governors of Kansas and Missouri appointed Task Forces to study, review and recommend action with regard to the metropolitan culture district, and those Task Forces having unanimously recommended to the county governing bodies of Johnson and Wyandotte in Kansas and Jackson, Clay and Platte in Missouri, that a metropolitan culture district should be created and that a retail sales tax of one-eighth (1/8) of one cent be levied for the purpose of restoring Union Station and the creation of a science museum at Union Station and that the tax levy shall terminate upon collection of $118,000,000 from the District; and

WHEREAS, restoration of Union Station and construction of Science City represents an historic opportunity for cooperation among the citizens of the metropolitan area to be served by the District; and

WHEREAS, the Board has determined that the report and recommendations of the Task Forces should be accepted; that the creation of and participation in the metropolitan culture district, as recommended, is in the best interests of the citizens of the County; that the levy of a tax, as recommended by the Task Forces, for financial support of the district on a cooperative basis with other counties would be economically practical and cost beneficial to the citizens of the County; and that the citizens of the participating counties should be given the opportunity to vote upon implementing the metropolitan culture district.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Johnson County, Kansas that:

1. Subject to approval by the voters of the County, the creation of and participation in the metropolitan culture district and the levy of a retailers' sales tax in the amount of one-eighth (1/8) of one cent, (.125%), for financing the district, are hereby authorized for and within Johnson County, Kansas;

2. The Johnson County Election Commissioner is hereby requested to submit the following specified ballot question to the qualified electors of Johnson County, Kansas at the next general election to be held on November 5, 1996, and a copy of this Resolution shall be printed upon the ballot, and in the notice of election, with the question to be voted upon:

3. If a majority of the qualified voters voting at said election in both Jackson County, Missouri and Johnson County, Kansas shall vote in favor of the approval of this Resolution, then the tax provisions shall be binding and become effective April 1, 1997. The remaining provisions hereof shall become effective immediately upon voter approval.

4. This Resolution is effective immediately upon passage.

5. The Resolution shall be published as required by law.
